Warranty is only for original owner. Same experience if you bought a lightly used Specialized, Trek, Knolly, Pivot or any others. Bottom line is, for me, the reason for going with boutique brands is to 1. get quality that you don't get from mass manufacturers and 2. get support when things go bad, but I feel I have been let down in both. I am going to beat the crap out of this bike now and unless the rear brake keeps giving me issue, I am sure I'll have a blast on it, but I won't be going the same route again.

I don't see a single reason why Ibis would deny a warranty claim on this frame. Those holes being out of alignment has nothing to do with what owner owns the frame. That's a mftr'ing defect. HOWEVER, are you absolutely positive the rear swingarm is aligned correctly on the pivots? Maybe one or two of the bearings on the links aren't all the way pushed in? If you bought that frame from a DEALER, then you should be the only owner, no? If this was a lemon frame, I would be highly suspicious of the linkage alignment, not just the rear triangle.It is a used frame and the swing arm is a "good will free of charge" replacement of the original one that the previous owner cracked in a crash. He decided not to spend $400 on a crash replacement, Ibis sent him this crooked piece and then his LBS promptly sold it as a like new flawless frame to me.
I can mostly blame myself for getting into this position but Ibis should not let out of spec frames out.
