Personally I like the Riot, it's cleaner and the geo is really good, but it really depends on a lot of stuff like free rider said.

I personally like the ToP. If your taller like me, the Top is availble with a longer top tube. Plus Transition is a great company to deal with. But I haven't dealt with BlackMarket.

I x up into my pedals. does the riot or ToP front tire hit the pedal when x up?

I highly doubt either bike has trouble with that. Unless you have monster feet.
