ELIGIBILITY:
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. The EAS Contest IS OPEN ONLY TO UNITED STATES RESIDENTS 18 YEARS OF AGE
OR OLDER AT TIME OF ENTRY. Employees of EAS or MtbREVIEW.com (and
the immediate family members of all such employees and all others
with whom they are domiciled) are not eligible to win prizes. The
EAS Contest is subject to all federal, state, and local
laws and regulations. Void where prohibited.
HOW
TO ENTER:
Enter by visiting www.mtbr.com and following all instructions for
completing the survey and entry form that appear in the Contest
area. The EAS Contest will begin at 2:01 p.m.
(PST) on Friday, December 23, 2005 and all entries must be received
by 1:00 p.m. (PST) on Friday January 27, 2006 (the "Contest
Period"). You may enter the Contest once per person, three
(3) prizes will be awarded (1st Prize: Santa Cruz Nomad Frame, 2nd Prize: Fox Racing Shox F100RLT Fork,
3rd Prize: $1000 worth of WTB products). All entrants will receive an EAS Energy System Sample Pack (1). In the event of a dispute, all
surveys and entry forms will be deemed to have been submitted by
the owner of the e-mail account from which they were sent. EAS
and MtbREVIEW.com will not be responsible or liable for
incomplete, late, lost, or misdirected entries or for failure to
receive entries due to transmission failures or technical failures
of any kind, including, without limitation, electronic malfunctioning
of any network, hardware, or software. All surveys and entry forms
become the property of EAS and MtbREVIEW.com immediately
upon submission. Email addresses will also be added to EAS
and MtbREVIEW.com's database for newsletter sign-ups and opt-in
emails for receiving special email offers from our merchant partners.
Your email will not be sold or rented to third-party merchants—this
list will be maintained by MtbREVIEW.com and EAS. You
will receive no more than one message per week, and you can unsubscribe
from the MtbREVIEW newsletter or special offer mailings at any time.
HOW
TO PLAY:
To participate, you must fully complete the entry form. Please answer
all the questions on the entry form completely and submit them to
EAS electronically by clicking on the Submit button.
This will send the survey and entry form to EAS, in which
case you will be entered in a drawing for the prize described. Only
complete entry forms will be eligible to participate in the Contest.
PRIZES:
Three (3) Prize winners will be randomly selected from among all
eligible entries received during the Contest Period. The drawing
will be held on or about February 10, 2005, after all the results have been tabulated. The First Place Prize (1) is a Santa Cruz Nomad Frame.
The Second Place Prize (1) is a Fox Racing Shox F100RLT Fork. The Third Place Prize (1) is $1000 worth in WTB Products.
In addition, all entrants will receive an EAS Energy System Sample Pack (1).
The winners are responsible for all other expenses associated with the acceptance or use of
the prize. The winners will be chosen at random out of the eligible entries, and the First Place, Second Place, and
Third Place prizes will be assigned at random; the winners will NOT have their choice of prizes.
ODDS:
The odds of winning a prize depend on the number of eligible entries
received during the Contest Period.
WINNING
AND NOTIFICATION:
The winner will be notified by e-mail on or about Friday February 10, 2006. Winners will be announced on February 14, 2006.
Prize winners are solely responsible for the reporting and payment
of any taxes on prizes. Any winner may waive his or her right to
receive a prize, by any one of the following methods: (a) At the
time the winner is notified by email, the winner may indicate that
he or she intends to waive the prize, in which case the prize will
not be delivered if the winner has delivered a signed, written waiver
to EAS within ten (10) days after such notification;
(b) At any time after notification but prior to delivery of the
prize, the winner may waive the prize by delivering a signed, written
waiver to EAS; or (c) After delivery of the prize, the
winner may return the prize to EAS, along with a signed,
written waiver, in which case the winner shall be responsible for
all shipping costs in order to return the prize. No cash or other
substitution is allowed. Rights to receive a prize are non-assignable
and non-transferable. Submission of a survey and entry form constitutes
the contestant's representation that he or she is eligible to participate.
Except where prohibited, participation in the Contest also constitutes
the winner's consent to the publication of his or her name and/or
image on the EAS or MtbREVIEW web pages, and to the inclusion
of his or her name and/or image in any other related publications
or web sites for any commercial or promotional purpose, without
limitation or additional compensation.
If we are unable to contact the selected winner after two attempts via email, a new
winner may be selected at which time the winner initially contacted, will no longer
be awarded the prize.
RESTRICTIONS:
Prize is not transferable. Prize cannot be redeemed for cash value.
* Participation in the Contest constitutes an agreement by each
contestant to comply with these Official Rules. EAS reserves the
right to cancel or modify the Contest if it determines, in its sole
discretion, that fraud or technical failures have destroyed the
integrity of the Contest.
* By participating in the Contest, each contestant agrees that (a)
any and all disputes, claims, and causes of action arising out of
or connected with the Contest, or any prizes awarded, shall be resolved
individually, without resort to any form of class action, by arbitration
conducted in California according to the rules of the California
Arbitration Act; (b) any and all claims, judgments, and awards shall
be limited to actual out-of-pocket costs incurred, including costs
associated with entering the Contest, but in no event attorney's
fees; and (c) under no circumstances will any contestant be permitted
to obtain any award for, and entrant hereby waives all rights to
claim, punitive, incidental, or consequential damages, or any other
damages, other than for actual out-of-pocket expenses, and any and
all rights to have damages multiplied or otherwise increased.
* All issues and questions concerning the construction, validity,
interpretation, and enforceability of these Official Rules, or the
rights and obligations of the contestant and EAS in connection
with the Contest, shall be governed by, and construed in accordance
with, the laws of the State of California, without giving effect
to any choice of law rules or provisions (whether of the State of
California, or any other jurisdiction) that would cause the application
of the laws of any jurisdiction other than the State of California.
The
EAS Contest is sponsored by EAS, whose decisions regarding
the selection of winners and all other aspects of the Contest shall
be final and binding in all respects. EAS and MtbREVIEW.com will
not be responsible for typographical or other inadvertent errors
in these Official Rules or in other Contest materials. If you have
